中華全國總工會關于印發 《事業單位工會工作條例》 的通知

《事業單位(wei)工(gong)(gong)會工(gong)(gong)作條(tiao)例》已經(jing)中華(hua)全國總工(gong)(gong)會第十六屆書記處第一(yi)百(bai)次會議審議通(tong)過,現印發給(gei)你們,請結合實際,認真貫徹執(zhi)行(xing)。

事業單位工會工作條例(li)


第一章(zhang)   總   則(ze)

第(di)一條(tiao)   為深入推進新時代事(shi)業(ye)(ye)單(dan)位(wei)工(gong)會工(gong)作(zuo)改革創新,充分發揮(hui)事(shi)業(ye)(ye)單(dan)位(wei)工(gong)會作(zuo)用,促進事(shi)業(ye)(ye)單(dan)位(wei)改革發展,根(gen)據 《中(zhong)華人民共和國工(gong)會法》 《中(zhong)國工(gong)會章程》,制(zhi)定本(ben)條(tiao)例。

第二條(tiao)   本條(tiao)例所指事(shi)業單位工會(hui)(hui)是指國(guo)家(jia)為了(le)社會(hui)(hui)公(gong)益(yi)目的(de)(de)(de),由國(guo)家(jia)機關舉辦(ban)或者(zhe)其(qi)他(ta)社會(hui)(hui)組(zu)(zu)織(zhi)(zhi)利用(yong)國(guo)有資產舉辦(ban)的(de)(de)(de),從事(shi)教(jiao)育、科技(ji)、文化、衛生、體育等活動的(de)(de)(de)社會(hui)(hui)服務組(zu)(zu)織(zhi)(zhi)中依法建(jian)立的(de)(de)(de)工會(hui)(hui)組(zu)(zu)織(zhi)(zhi)。

第三條   事業單(dan)位(wei)工(gong)(gong)會以(yi)馬(ma)克思列寧主(zhu)義(yi)(yi)(yi)、毛澤東思想、鄧小平理論、 “三個代(dai)(dai)表”重要思想、科學發(fa)展觀、習近平新(xin)時代(dai)(dai)中國(guo)特色(se)社(she)(she)(she)會主(zhu)義(yi)(yi)(yi)思想為指(zhi)導,堅持(chi)正確政治方向,堅持(chi)圍繞中心、服務(wu)(wu)大局,牢牢把握(wo)為實(shi)現中華(hua)民族(zu)偉大復(fu)興(xing)的中國(guo)夢而奮斗的工(gong)(gong)人運動時代(dai)(dai)主(zhu)題,堅定不移(yi)走中國(guo)特色(se)社(she)(she)(she)會主(zhu)義(yi)(yi)(yi)工(gong)(gong)會發(fa)展道路(lu),推進事業單(dan)位(wei)工(gong)(gong)會制度化、規范(fan)化建(jian)設,加強(qiang)維(wei)權服務(wu)(wu),積極創新(xin)實(shi)踐,強(qiang)化責任擔當(dang),團結(jie)動員事業單(dan)位(wei)職工(gong)(gong)群眾為全(quan)面建(jian)成小康社(she)(she)(she)會、奪取新(xin)時代(dai)(dai)中國(guo)特色(se)社(she)(she)(she)會主(zhu)義(yi)(yi)(yi)偉大勝利、實(shi)現中華(hua)民族(zu)偉大復(fu)興(xing)的中國(guo)夢作出積極貢獻。

第四條   事業單位(wei)工會(hui)接受同級(ji)黨組織(zhi)和(he)上級(ji)工會(hui)雙重領導(dao),以同級(ji)黨組織(zhi)領導(dao)為主。對(dui)不(bu)在(zai)(zai)事業單位(wei)所在(zai)(zai)地的直屬單位(wei)工會(hui),實(shi)行(xing)屬地管(guan)理原則(ze)。

第五條(tiao)   事業(ye)單位(wei)工(gong)會(hui)工(gong)作應遵循把(ba)握以下(xia)原則(ze):堅持黨(dang)(dang)的領導,貫徹落實(shi)黨(dang)(dang)的全(quan)心全(quan)意依靠工(gong)人(ren)階級的根(gen)本指導方(fang)針(zhen),始終保(bao)持正確的政(zheng)治方(fang)向;堅持以職(zhi)工(gong)為(wei)本,保(bao)持和(he)增(zeng)強政(zheng)治性(xing)、先進性(xing)、群眾性(xing),發揮(hui)聯系職(zhi)工(gong)橋梁紐帶作用;堅持依法依規,做到依法建(jian)(jian)會(hui)、依法管會(hui)、依法履職(zhi)、依法維權;堅持改革(ge)創(chuang)新,適應形(xing)勢任務要求,積極探(tan)索實(shi)踐,不(bu)斷加強自身建(jian)(jian)設(she),把(ba)工(gong)會(hui)組(zu)織建(jian)(jian)設(she)得更加充滿活力(li)(li)、更加堅強有力(li)(li),努力(li)(li)增(zeng)強吸引力(li)(li)凝聚力(li)(li)戰斗力(li)(li)。

第二章   組(zu)織建設

第六(liu)條   事業單位應當依法建立(li)工(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)組(zu)織,組(zu)織職(zhi)(zhi)工(gong)(gong)(gong)加入工(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)。會(hui)(hui)(hui)(hui)(hui)員(yuan)(yuan)二十五(wu)人(ren)以(yi)上的(de)事業單位建立(li)工(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)委員(yuan)(yuan)會(hui)(hui)(hui)(hui)(hui);不(bu)足二十五(wu)人(ren)的(de)可(ke)以(yi)單獨建立(li)工(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)委員(yuan)(yuan)會(hui)(hui)(hui)(hui)(hui),也(ye)可(ke)以(yi)由兩個以(yi)上事業單位的(de)會(hui)(hui)(hui)(hui)(hui)員(yuan)(yuan)聯合(he)建立(li)工(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)基(ji)層(ceng)委員(yuan)(yuan)會(hui)(hui)(hui)(hui)(hui),也(ye)可(ke)以(yi)選舉組(zu)織員(yuan)(yuan)或者工(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)主(zhu)席一(yi)人(ren),主(zhu)持工(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)工(gong)(gong)(gong)作。同時按有關規定(ding)建立(li)工(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)經費審查委員(yuan)(yuan)會(hui)(hui)(hui)(hui)(hui)、工(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)女職(zhi)(zhi)工(gong)(gong)(gong)委員(yuan)(yuan)會(hui)(hui)(hui)(hui)(hui)。

第(di)七條   會(hui)(hui)員(yuan)(yuan)人數較多的事(shi)業(ye)單位(wei)工(gong)(gong)會(hui)(hui)組(zu)織(zhi),可以(yi)根據需(xu)要設立(li)專門(men)工(gong)(gong)作委(wei)員(yuan)(yuan)會(hui)(hui),承擔(dan)工(gong)(gong)會(hui)(hui)委(wei)員(yuan)(yuan)會(hui)(hui)的有(you)關工(gong)(gong)作。事(shi)業(ye)單位(wei)內設機構,可以(yi)建立(li)工(gong)(gong)會(hui)(hui)分(fen)會(hui)(hui)或工(gong)(gong)會(hui)(hui)小(xiao)組(zu)。

第八(ba)條   事業單(dan)位工會具備(bei)法人(ren)條件(jian)的,依(yi)法取得(de)社團法人(ren)資格,工會主席為法定代表(biao)人(ren)。

第九條   事業(ye)單位工會(hui)受法(fa)律保護(hu),不得隨(sui)意撤銷(xiao)(xiao)、合并或歸屬其他部門(men)。事業(ye)單位被(bei)撤銷(xiao)(xiao),其工會(hui)組織相應撤銷(xiao)(xiao),并報(bao)告(gao)上(shang)一(yi)級工會(hui),已取得社團(tuan)法(fa)人資格的,辦理社團(tuan)法(fa)人注銷(xiao)(xiao)手續。事業(ye)單位改革改制,應同時(shi)建立健全工會(hui)組織和(he)相應機(ji)構。

第(di)十條(tiao)   會(hui)員(yuan)大會(hui)或會(hui)員(yuan)代表大會(hui)每年至少召(zhao)開一次會(hui)議(yi)(yi)。經(jing)事(shi)業單(dan)位工會(hui)委員(yuan)會(hui)或三分之一以上會(hui)員(yuan)提議(yi)(yi),可臨(lin)時召(zhao)開會(hui)議(yi)(yi)。

第十一(yi)條(tiao)   會(hui)(hui)員(yuan)代表(biao)大會(hui)(hui)的代表(biao)實行常任制,任期與本單位(wei)工會(hui)(hui)委員(yuan)會(hui)(hui)相同。

第十二條   會(hui)(hui)員(yuan)在一百人(ren)以下的(de)事業單(dan)位(wei)工會(hui)(hui)應召開會(hui)(hui)員(yuan)大(da)會(hui)(hui)。

第十三條(tiao)   會員(yuan)大會或會員(yuan)代表大會的(de)職(zhi)權:

(一)審議和批準(zhun)工會委員會的(de)工作報(bao)告(gao);

(二(er))審(shen)議和(he)批(pi)準工(gong)會委員會的經(jing)費(fei)收支情況報告和(he)經(jing)費(fei)審(shen)查委員會的工(gong)作報告;

(三(san))選舉(ju)工會(hui)委員會(hui)和經費審查委員會(hui);

(四)撤換或罷免其所選舉的(de)代表(biao)或工會委(wei)員會組成人(ren)員;

(五)討論決定工(gong)會工(gong)作(zuo)其他重大問題;

(六)公開工會內部(bu)事務;

(七)民主(zhu)評議和監督工(gong)會工(gong)作及工(gong)會負責人。

第十四條   會員代表大(da)(da)會或會員大(da)(da)會與職(zhi)(zhi)工代表大(da)(da)會(或職(zhi)(zhi)工大(da)(da)會,下同)須分(fen)別行使職(zhi)(zhi)權,不得相互替代。

第十五(wu)條   大型事(shi)業(ye)單(dan)位(wei)工(gong)會(hui)(hui)(hui)(hui)委(wei)(wei)(wei)(wei)員(yuan)(yuan)會(hui)(hui)(hui)(hui),根據(ju)工(gong)作(zuo)需(xu)要,經上級工(gong)會(hui)(hui)(hui)(hui)批(pi)準(zhun),可(ke)設立(li)常務委(wei)(wei)(wei)(wei)員(yuan)(yuan)會(hui)(hui)(hui)(hui),負責工(gong)會(hui)(hui)(hui)(hui)委(wei)(wei)(wei)(wei)員(yuan)(yuan)會(hui)(hui)(hui)(hui)的日常工(gong)作(zuo),其下屬單(dan)位(wei)可(ke)建(jian)立(li)工(gong)會(hui)(hui)(hui)(hui)委(wei)(wei)(wei)(wei)員(yuan)(yuan)會(hui)(hui)(hui)(hui)。事(shi)業(ye)單(dan)位(wei)工(gong)會(hui)(hui)(hui)(hui)委(wei)(wei)(wei)(wei)員(yuan)(yuan)會(hui)(hui)(hui)(hui)委(wei)(wei)(wei)(wei)員(yuan)(yuan)和(he)常務委(wei)(wei)(wei)(wei)員(yuan)(yuan)會(hui)(hui)(hui)(hui)委(wei)(wei)(wei)(wei)員(yuan)(yuan)應(ying)差(cha)(cha)額選(xuan)(xuan)(xuan)舉(ju)(ju)產(chan)生,可(ke)以直接采(cai)用候選(xuan)(xuan)(xuan)人數(shu)多(duo)于應(ying)選(xuan)(xuan)(xuan)人數(shu)的差(cha)(cha)額選(xuan)(xuan)(xuan)舉(ju)(ju)辦(ban)法進行(xing)正式(shi)選(xuan)(xuan)(xuan)舉(ju)(ju),也可(ke)以先采(cai)用差(cha)(cha)額選(xuan)(xuan)(xuan)舉(ju)(ju)辦(ban)法進行(xing)預(yu)選(xuan)(xuan)(xuan)產(chan)生候選(xuan)(xuan)(xuan)人名(ming)單(dan),然后進行(xing)正式(shi)選(xuan)(xuan)(xuan)舉(ju)(ju)。委(wei)(wei)(wei)(wei)員(yuan)(yuan)會(hui)(hui)(hui)(hui)委(wei)(wei)(wei)(wei)員(yuan)(yuan)和(he)常務委(wei)(wei)(wei)(wei)員(yuan)(yuan)會(hui)(hui)(hui)(hui)委(wei)(wei)(wei)(wei)員(yuan)(yuan)的差(cha)(cha)額率(lv)分別不低(di)于 5% 和(he) 10% 。選(xuan)(xuan)(xuan)舉(ju)(ju)結果報上一級工(gong)會(hui)(hui)(hui)(hui)批(pi)準(zhun)。

第十六條   事(shi)業單位工會(hui)(hui)委員(yuan)(yuan)會(hui)(hui)是會(hui)(hui)員(yuan)(yuan)大(da)(da)會(hui)(hui)或會(hui)(hui)員(yuan)(yuan)代(dai)表(biao)大(da)(da)會(hui)(hui)的常(chang)設機構,對會(hui)(hui)員(yuan)(yuan)大(da)(da)會(hui)(hui)或會(hui)(hui)員(yuan)(yuan)代(dai)表(biao)大(da)(da)會(hui)(hui)負責,接受(shou)會(hui)(hui)員(yuan)(yuan)監督。在(zai)會(hui)(hui)員(yuan)(yuan)大(da)(da)會(hui)(hui)或會(hui)(hui)員(yuan)(yuan)代(dai)表(biao)大(da)(da)會(hui)(hui)閉會(hui)(hui)期間(jian),負責日常(chang)工作。

第十七條   事(shi)業單位工會(hui)(hui)委員(yuan)(yuan)(yuan)會(hui)(hui)和(he)經(jing)費審查委員(yuan)(yuan)(yuan)會(hui)(hui)每屆(jie)任期三年至五年,具體任期由(you)會(hui)(hui)員(yuan)(yuan)(yuan)大會(hui)(hui)或(huo)者會(hui)(hui)員(yuan)(yuan)(yuan)代表(biao)大會(hui)(hui)決定。任期屆(jie)滿,應當如期召開會(hui)(hui)員(yuan)(yuan)(yuan)大會(hui)(hui)或(huo)者會(hui)(hui)員(yuan)(yuan)(yuan)代表(biao)大會(hui)(hui),進行(xing)換屆(jie)選舉。特殊(shu)情況下(xia),經(jing)上一級工會(hui)(hui)批準,可以提前或(huo)者延(yan)期舉行(xing),延(yan)期時間一般不超過(guo)半(ban)年。

第十八條   工會委員會實行民主集中制,重(zhong)(zhong)要人事事項(xiang)、大額財務支(zhi)出、資產處置、評(ping)先評(ping)優等重(zhong)(zhong)大問題(ti)、重(zhong)(zhong)要事項(xiang)須經集體(ti)討論作出決定(ding)。

第十九條   工會委員會 (常委會)一(yi)般每季(ji)度召開一(yi)次會議(yi),討(tao)論或決定下列事項:

(一)貫徹黨組織、上級工(gong)會(hui)有(you)關(guan)決(jue)(jue)定(ding)和工(gong)作(zuo)部署,執行會(hui)員大(da)會(hui)或會(hui)員代表大(da)會(hui)決(jue)(jue)議;

(二)向黨組(zu)織、上級工(gong)(gong)會提交(jiao)的(de)重要請示、報告(gao),向會員大(da)會或會員代表大(da)會提交(jiao)的(de)工(gong)(gong)作報告(gao);

(三(san))工(gong)會工(gong)作計(ji)劃(hua)和總結;

(四)向行(xing)政提出涉及(ji)單位發展、有關維護服務職工重大問題(ti)的建(jian)議(yi);

(五)工(gong)會經費(fei)預算(suan)執行情況及重(zhong)大財(cai)務支出(chu);

(六)由(you)工(gong)會委員會討(tao)論和決定的其(qi)他事項。

第三章   職責(ze)任務

第二十條   事業單位(wei)工會(hui)的(de)職(zhi)責(ze)任(ren)務:

(一)堅持(chi)用習(xi)近平新時(shi)代(dai)中國特(te)(te)色(se)社會(hui)(hui)主義思(si)想武裝頭腦(nao),認真學習(xi)貫徹(che)黨的(de)基(ji)本(ben)理(li)論、基(ji)本(ben)路線、基(ji)本(ben)方略,教(jiao)育(yu)引(yin)導職工(gong)樹立共產主義遠大理(li)想和中國特(te)(te)色(se)社會(hui)(hui)主義共同(tong)理(li)想,團結引(yin)導職工(gong)群眾聽黨話、跟黨走。

(二)培(pei)育(yu)和踐(jian)行社(she)會主義核心(xin)價值觀,加強和改進職(zhi)(zhi)工(gong)思想(xiang)(xiang)政治工(gong)作,開展理想(xiang)(xiang)信念教育(yu),實施(shi)道(dao)德(de)建設工(gong)程(cheng),培(pei)養(yang)職(zhi)(zhi)工(gong)的社(she)會公(gong)德(de)、職(zhi)(zhi)業(ye)道(dao)德(de)、家庭美德(de)、個(ge)人品德(de),深化群(qun)眾性精神文明(ming)創建活動,提高職(zhi)(zhi)工(gong)的思想(xiang)(xiang)覺悟(wu)、道(dao)德(de)水準、文明(ming)素養(yang)。

(三)弘揚勞(lao)(lao)模精(jing)神、勞(lao)(lao)動(dong)精(jing)神、工匠精(jing)神,營造勞(lao)(lao)動(dong)光榮的社會風(feng)尚和精(jing)益求精(jing)的敬業風(feng)氣,深(shen)入開展勞(lao)(lao)動(dong)和技(ji)能競賽,開展群眾性技(ji)術創新、技(ji)能培(pei)訓等活動(dong),提(ti)升職(zhi)工技(ji)能技(ji)術素質,建(jian)設知識型(xing)、技(ji)能型(xing)、創新型(xing)職(zhi)工隊伍。

(四)加強(qiang)職工文化(hua)建(jian)設,注重人文關懷和心理疏導,開展主題(ti)文化(hua)體育活(huo)動,豐富職工精神文化(hua)生(sheng)活(huo)。

(五)加強以(yi)職(zhi)(zhi)工代表大會為基(ji)本(ben)形(xing)式的民主管(guan)理工作,深(shen)入推進事業單(dan)位內部(bu)事務公開(kai),落(luo)實職(zhi)(zhi)工的知情權(quan)、參與權(quan)、表達(da)權(quan)、監督權(quan)。

(六)做(zuo)好職工維權工作,開(kai)展集(ji)體協商(shang),構建和諧勞動人(ren)事關系,協調處理勞動人(ren)事爭議,推動解決勞動就業、技能培(pei)訓、工資報酬(chou)、安(an)全(quan)健(jian)康、社(she)會保(bao)障以及(ji)職業發展、民主權益(yi)、精神文化需(xu)求(qiu)等問(wen)題(ti)。

(七)做好服務職工工作,傾聽職工意見,反(fan)映職工訴求,協助黨政辦好職工集體(ti)福利事(shi)業,開展困難職工幫扶,組織職工參加療養、休養及健康體(ti)檢,為職工辦實事(shi)、做好事(shi)、解難事(shi)。

(八)加強工會(hui)(hui)組織建設,建立健全工會(hui)(hui)內部(bu)運行(xing)和(he)開展(zhan)工作(zuo)的(de)各項制度,做(zuo)好(hao)會(hui)(hui)員的(de)發展(zhan)、接轉(zhuan)、教育(yu)和(he)會(hui)(hui)籍管(guan)理(li)工作(zuo),加強對(dui)專(zhuan) (兼)職工會(hui)(hui)干部(bu)和(he)工會(hui)(hui)積極分子的(de)培(pei)養,深(shen)入開展(zhan) “職工之(zhi)家”和(he) “職工小家”創建活動。

(九(jiu))收好(hao)、管(guan)(guan)好(hao)、用好(hao)工會經費(fei),管(guan)(guan)理使用好(hao)工會資產,加強工會經費(fei)和工會資產審查(cha)審計(ji)監督工作。

第四章   工作制(zhi)度

第二(er)十一(yi)條(tiao)   職(zhi)工(gong)(gong)(gong)代(dai)(dai)表(biao)(biao)大(da)會(hui)是(shi)(shi)事(shi)業單(dan)(dan)位(wei)實行(xing)民主管(guan)(guan)理的(de)基本形式,是(shi)(shi)職(zhi)工(gong)(gong)(gong)行(xing)使民主管(guan)(guan)理權(quan)力的(de)機構。事(shi)業單(dan)(dan)位(wei)職(zhi)工(gong)(gong)(gong)代(dai)(dai)表(biao)(biao)大(da)會(hui)每三(san)年至五年為一(yi)屆,每年至少召(zhao)開一(yi)次。召(zhao)開職(zhi)工(gong)(gong)(gong)代(dai)(dai)表(biao)(biao)大(da)會(hui)正式會(hui)議,必(bi)須有全體職(zhi)工(gong)(gong)(gong)代(dai)(dai)表(biao)(biao)三(san)分之二(er)以上出(chu)席。事(shi)業單(dan)(dan)位(wei)工(gong)(gong)(gong)會(hui)是(shi)(shi)職(zhi)工(gong)(gong)(gong)代(dai)(dai)表(biao)(biao)大(da)會(hui)工(gong)(gong)(gong)作機構,負責(ze)職(zhi)工(gong)(gong)(gong)代(dai)(dai)表(biao)(biao)大(da)會(hui)的(de)日常工(gong)(gong)(gong)作。事(shi)業單(dan)(dan)位(wei)工(gong)(gong)(gong)會(hui)承擔以下與職(zhi)工(gong)(gong)(gong)代(dai)(dai)表(biao)(biao)大(da)會(hui)相關的(de)工(gong)(gong)(gong)作職(zhi)責(ze):

(一)做好職工代(dai)表(biao)大(da)會(hui)的籌備工作(zuo)和會(hui)務(wu)工作(zuo),組織(zhi)選舉職工代(dai)表(biao)大(da)會(hui)代(dai)表(biao),征集和整理提案,提出會(hui)議(yi)議(yi)題、方案和主席團建(jian)議(yi)人選;

(二)職工代表大會閉會期間,組(zu)織傳(chuan)達貫徹會議精神,督促檢(jian)查(cha)會議決(jue)議的(de)落實;

(三)組織職(zhi)(zhi)工(gong)代表的(de)培訓,接受(shou)和(he)處理職(zhi)(zhi)工(gong)代表的(de)建議和(he)申訴;

(四(si))就本單位(wei)民(min)主管理(li)工(gong)作向單位(wei)黨組織匯(hui)報(bao);

(五)完成(cheng)職(zhi)工(gong)(gong)代表大會(hui)(hui)委托的(de)其他任務。事業單位應當(dang)為本單位工(gong)(gong)會(hui)(hui)承擔(dan)職(zhi)工(gong)(gong)代表大會(hui)(hui)工(gong)(gong)作(zuo)機構的(de)職(zhi)責提供必要的(de)工(gong)(gong)作(zuo)條件和經費保障。

第(di)二十二條(tiao)   事(shi)業單(dan)位的(de)黨(dang)政(zheng)工聯席(xi)會議,研究和解決事(shi)關職(zhi)工切身利益的(de)重(zhong)要問題,由本單(dan)位工會召(zhao)集。

第二十(shi)三條   建立和規范(fan)事(shi)務公開(kai)(kai)(kai)(kai)制度(du),協助黨政做好事(shi)務公開(kai)(kai)(kai)(kai)工作(zuo),明確公開(kai)(kai)(kai)(kai)內容,拓展公開(kai)(kai)(kai)(kai)形(xing)式,并做好民主監督。

第二十四條   暢(chang)通職工表達合理訴求渠道(dao),通過(guo)協商、協調、溝(gou)通的辦法(fa),化(hua)解勞(lao)動人(ren)事矛盾,構建和諧勞(lao)動人(ren)事關(guan)系(xi)。

第二十(shi)五條   建(jian)立健全勞動人事(shi)(shi)(shi)關系(xi)調解機制,協商(shang)解決(jue)(jue)涉及職工(gong)(gong)切(qie)身利(li)益的問(wen)題。建(jian)立和完善(shan)科學有效(xiao)的利(li)益協調機制、訴求表(biao)達(da)機制、權益保障機制。建(jian)立勞動人事(shi)(shi)(shi)關系(xi)爭(zheng)議(yi)預(yu)警機制,做好勞動人事(shi)(shi)(shi)關系(xi)爭(zheng)議(yi)預(yu)測(ce)、預(yu)報、預(yu)防工(gong)(gong)作。事(shi)(shi)(shi)業單位(wei)工(gong)(gong)會(hui)應(ying)當積極同(tong)有關方面協商(shang),表(biao)達(da)職工(gong)(gong)訴求,提出解決(jue)(jue)的意見(jian)建(jian)議(yi)。

第五章   自(zi)身建設(she)

第二十六條   事業(ye)單位依法依規設置工會工作(zuo)機(ji)(ji)構,明(ming)確主要職(zhi)責、機(ji)(ji)構規格、領導職(zhi)數(shu)和編(bian)制數(shu)額(e)。

第二(er)十七(qi)條   事(shi)(shi)業(ye)(ye)單(dan)(dan)位(wei)(wei)工(gong)(gong)(gong)(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)主(zhu)(zhu)席(xi)(xi)應(ying)以專(zhuan)職(zhi)為(wei)主(zhu)(zhu),兼職(zhi)為(wei)輔。職(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)兩百人(ren)以上(shang)的事(shi)(shi)業(ye)(ye)單(dan)(dan)位(wei)(wei),設專(zhuan)職(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)主(zhu)(zhu)席(xi)(xi)。工(gong)(gong)(gong)(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)專(zhuan)職(zhi)工(gong)(gong)(gong)(gong)(gong)(gong)作(zuo)人(ren)員(yuan)的具(ju)體(ti)人(ren)數由事(shi)(shi)業(ye)(ye)單(dan)(dan)位(wei)(wei)工(gong)(gong)(gong)(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)與單(dan)(dan)位(wei)(wei)行(xing)政協商確定。根(gen)據工(gong)(gong)(gong)(gong)(gong)(gong)作(zuo)需要(yao)和(he)經費許可(ke),事(shi)(shi)業(ye)(ye)單(dan)(dan)位(wei)(wei)工(gong)(gong)(gong)(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)可(ke)從社會(hui)(hui)(hui)(hui)(hui)聘用工(gong)(gong)(gong)(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)工(gong)(gong)(gong)(gong)(gong)(gong)作(zuo)人(ren)員(yuan),建立專(zhuan)兼職(zhi)相結合(he)的干部隊伍。事(shi)(shi)業(ye)(ye)單(dan)(dan)位(wei)(wei)工(gong)(gong)(gong)(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)主(zhu)(zhu)席(xi)(xi)、副(fu)(fu)主(zhu)(zhu)席(xi)(xi)和(he)委員(yuan)實行(xing)任期制(zhi),可(ke)以連選(xuan)連任。工(gong)(gong)(gong)(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)主(zhu)(zhu)席(xi)(xi)、副(fu)(fu)主(zhu)(zhu)席(xi)(xi)因工(gong)(gong)(gong)(gong)(gong)(gong)作(zuo)需要(yao)調動時,應(ying)當征得本級工(gong)(gong)(gong)(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)委員(yuan)會(hui)(hui)(hui)(hui)(hui)和(he)上(shang)一(yi)(yi)級工(gong)(gong)(gong)(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)的同(tong)意。工(gong)(gong)(gong)(gong)(gong)(gong)會(hui)(hui)(hui)(hui)(hui)主(zhu)(zhu)席(xi)(xi)、副(fu)(fu)主(zhu)(zhu)席(xi)(xi)空缺時,應(ying)當及(ji)時補選(xuan),空缺期限一(yi)(yi)般不(bu)超過半(ban)年。

第(di)二十八條   突出政治標(biao)準,選優配(pei)強事(shi)(shi)業單(dan)位工(gong)會(hui)領(ling)導(dao)班子(zi)和干(gan)(gan)部(bu)(bu)隊伍,牢固(gu)樹(shu)立政治意(yi)(yi)識(shi)、大局(ju)意(yi)(yi)識(shi)、核(he)心(xin)意(yi)(yi)識(shi)、看齊意(yi)(yi)識(shi),堅定道路(lu)自(zi)(zi)信(xin)(xin)、理(li)論自(zi)(zi)信(xin)(xin)、制度自(zi)(zi)信(xin)(xin)、文(wen)化自(zi)(zi)信(xin)(xin),堅決維護黨中央權威和集中統一領(ling)導(dao)。按照既(ji)要政治過(guo)硬、又要本領(ling)高強的要求,建設(she)忠誠干(gan)(gan)凈擔當的高素質(zhi)事(shi)(shi)業單(dan)位工(gong)會(hui)干(gan)(gan)部(bu)(bu)隊伍,注重培養(yang)專業能力、專業精(jing)神,提高做好群眾工(gong)作本領(ling)。

第六章   工會經費和資產

第二(er)十九(jiu)條   具備社團(tuan)法(fa)人(ren)資格(ge)的事業單位工(gong)會應當獨立設立經費(fei)賬(zhang)戶(hu)。工(gong)會經費(fei)支出(chu)實行工(gong)會法(fa)定代表人(ren)簽(qian)批制度。事業單位工(gong)會經費(fei)主要用于為職(zhi)工(gong)服務(wu)和工(gong)會活動。

第三十(shi)條   工(gong)會(hui)(hui)(hui)(hui)(hui)(hui)會(hui)(hui)(hui)(hui)(hui)(hui)員按規(gui)(gui)定(ding)標準和(he)程序(xu)繳納會(hui)(hui)(hui)(hui)(hui)(hui)費(fei)。建立工(gong)會(hui)(hui)(hui)(hui)(hui)(hui)組織(zhi)的事(shi)業(ye)(ye)單位,按每月(yue)全部(bu)職工(gong)工(gong)資總額(e)的百分之二向(xiang)事(shi)業(ye)(ye)單位工(gong)會(hui)(hui)(hui)(hui)(hui)(hui)撥(bo)(bo)繳工(gong)會(hui)(hui)(hui)(hui)(hui)(hui)經(jing)(jing)(jing)費(fei);由(you)財(cai)政統一(yi)劃撥(bo)(bo)經(jing)(jing)(jing)費(fei)的,工(gong)會(hui)(hui)(hui)(hui)(hui)(hui)經(jing)(jing)(jing)費(fei)列入同(tong)級(ji)財(cai)政預算,按財(cai)政統一(yi)劃撥(bo)(bo)方式(shi)執行(xing)。事(shi)業(ye)(ye)單位工(gong)會(hui)(hui)(hui)(hui)(hui)(hui)因工(gong)作需要(yao),可以依據 《中華人民共和(he)國工(gong)會(hui)(hui)(hui)(hui)(hui)(hui)法(fa)(fa)(fa)》等(deng)有(you)關規(gui)(gui)定(ding),向(xiang)單位行(xing)政申請經(jing)(jing)(jing)費(fei)補助。上(shang)級(ji)工(gong)會(hui)(hui)(hui)(hui)(hui)(hui)有(you)權對下級(ji)工(gong)會(hui)(hui)(hui)(hui)(hui)(hui)所在事(shi)業(ye)(ye)單位撥(bo)(bo)繳工(gong)會(hui)(hui)(hui)(hui)(hui)(hui)經(jing)(jing)(jing)費(fei)情況進(jin)行(xing)監督檢(jian)查。對無正當理(li)由(you)拖延或者拒不(bu)(bu)撥(bo)(bo)繳工(gong)會(hui)(hui)(hui)(hui)(hui)(hui)經(jing)(jing)(jing)費(fei)的單位,依據 《中華人民共和(he)國工(gong)會(hui)(hui)(hui)(hui)(hui)(hui)法(fa)(fa)(fa)》等(deng)有(you)關規(gui)(gui)定(ding)處理(li)。事(shi)業(ye)(ye)單位工(gong)會(hui)(hui)(hui)(hui)(hui)(hui)應當按照有(you)關規(gui)(gui)定(ding)收繳、上(shang)解(jie)工(gong)會(hui)(hui)(hui)(hui)(hui)(hui)經(jing)(jing)(jing)費(fei),依法(fa)(fa)(fa)獨立管(guan)理(li)和(he)使用工(gong)會(hui)(hui)(hui)(hui)(hui)(hui)經(jing)(jing)(jing)費(fei)。任何組織(zhi)和(he)個(ge)人不(bu)(bu)得截(jie)留、挪(nuo)用、侵占工(gong)會(hui)(hui)(hui)(hui)(hui)(hui)經(jing)(jing)(jing)費(fei)。

第(di)三十一(yi)條   事(shi)業(ye)(ye)單(dan)位工(gong)會(hui)(hui)應當根據經(jing)費(fei)(fei)獨立原則建立預算(suan)、決(jue)算(suan)和(he)(he)經(jing)費(fei)(fei)審(shen)查(cha)審(shen)計(ji)制(zhi)度(du),堅持遵紀(ji)守(shou)法(fa)、經(jing)費(fei)(fei)獨立、預算(suan)管理(li)、服(fu)務(wu)(wu)職工(gong)、勤儉節約、民主管理(li)的(de)(de)原則。事(shi)業(ye)(ye)單(dan)位工(gong)會(hui)(hui)應當建立健全財務(wu)(wu)制(zhi)度(du),完善經(jing)費(fei)(fei)使用流(liu)程和(he)(he)程序(xu),各(ge)項收支(zhi)實(shi)行工(gong)會(hui)(hui)委員(yuan)會(hui)(hui)集體領(ling)導下的(de)(de)主席負責制(zhi),重大收支(zhi)必須集體研(yan)究(jiu)決(jue)定。事(shi)業(ye)(ye)單(dan)位工(gong)會(hui)(hui)應根據國家和(he)(he)全國總工(gong)會(hui)(hui)的(de)(de)有關政策規定以及上(shang)(shang)級工(gong)會(hui)(hui)的(de)(de)要(yao)求(qiu),依法(fa)、科學、完整(zheng)、合理(li)地編制(zhi)工(gong)會(hui)(hui)經(jing)費(fei)(fei)年度(du)預 (決(jue))算(suan),按程序(xu)報(bao)上(shang)(shang)一(yi)級工(gong)會(hui)(hui)批(pi)準(zhun),嚴禁無預算(suan)、超預算(suan)使用工(gong)會(hui)(hui)經(jing)費(fei)(fei)。

第(di)三(san)十(shi)二(er)條(tiao)   各級人民政府和(he)(he)事業單位應當依法為(wei)事業單位工會辦(ban)公(gong)和(he)(he)開(kai)展活動提供必要的設施(shi)和(he)(he)活動場所等(deng)物質(zhi)條(tiao)件。工會經費、資(zi)產(chan)和(he)(he)國家撥給工會的不動產(chan)及撥付資(zi)金(jin)形成(cheng)的資(zi)產(chan),任(ren)何單位和(he)(he)個(ge)人不得侵占、挪用和(he)(he)任(ren)意(yi)調撥。

第(di)七(qi)章   工(gong)會(hui)經費(fei)審(shen)查審(shen)計

第三十三條   會(hui)(hui)(hui)(hui)(hui)(hui)(hui)員(yuan)(yuan)大會(hui)(hui)(hui)(hui)(hui)(hui)(hui)或者(zhe)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)員(yuan)(yuan)代表大會(hui)(hui)(hui)(hui)(hui)(hui)(hui)在選(xuan)舉事(shi)業單(dan)位工(gong)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)委(wei)員(yuan)(yuan)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)的(de)同(tong)時,選(xuan)舉產(chan)生經費審(shen)查(cha)(cha)委(wei)員(yuan)(yuan)會(hui)(hui)(hui)(hui)(hui)(hui)(hui),會(hui)(hui)(hui)(hui)(hui)(hui)(hui)員(yuan)(yuan)人數較少的(de),可以(yi)選(xuan)舉經費審(shen)查(cha)(cha)委(wei)員(yuan)(yuan)一人。經費審(shen)查(cha)(cha)委(wei)員(yuan)(yuan)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)主任、副主任由經費審(shen)查(cha)(cha)委(wei)員(yuan)(yuan)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)全體會(hui)(hui)(hui)(hui)(hui)(hui)(hui)議選(xuan)舉產(chan)生。經費審(shen)查(cha)(cha)委(wei)員(yuan)(yuan)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)主任按同(tong)級工(gong)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)副職(zhi)級配備。經費審(shen)查(cha)(cha)委(wei)員(yuan)(yuan)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)或者(zhe)經費審(shen)查(cha)(cha)委(wei)員(yuan)(yuan)的(de)選(xuan)舉結果,與事(shi)業單(dan)位工(gong)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)委(wei)員(yuan)(yuan)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)的(de)選(xuan)舉結果同(tong)時報(bao)上一級工(gong)會(hui)(hui)(hui)(hui)(hui)(hui)(hui)批準。

第三十(shi)四條   事(shi)業單位(wei)工會(hui)(hui)(hui)(hui)經費審查(cha)(cha)(cha)委員(yuan)(yuan)(yuan)會(hui)(hui)(hui)(hui)的任期與事(shi)業單位(wei)工會(hui)(hui)(hui)(hui)委員(yuan)(yuan)(yuan)會(hui)(hui)(hui)(hui)相同(tong),向同(tong)級會(hui)(hui)(hui)(hui)員(yuan)(yuan)(yuan)大會(hui)(hui)(hui)(hui)或者會(hui)(hui)(hui)(hui)員(yuan)(yuan)(yuan)代表(biao)大會(hui)(hui)(hui)(hui)負責(ze)并(bing)(bing)報(bao)告(gao)工作;在會(hui)(hui)(hui)(hui)員(yuan)(yuan)(yuan)大會(hui)(hui)(hui)(hui)或者會(hui)(hui)(hui)(hui)員(yuan)(yuan)(yuan)代表(biao)大會(hui)(hui)(hui)(hui)閉會(hui)(hui)(hui)(hui)期間,向同(tong)級工會(hui)(hui)(hui)(hui)委員(yuan)(yuan)(yuan)會(hui)(hui)(hui)(hui)負責(ze)并(bing)(bing)報(bao)告(gao)工作;事(shi)業單位(wei)工會(hui)(hui)(hui)(hui)經費審查(cha)(cha)(cha)委員(yuan)(yuan)(yuan)會(hui)(hui)(hui)(hui)應當接受上級工會(hui)(hui)(hui)(hui)經費審查(cha)(cha)(cha)委員(yuan)(yuan)(yuan)會(hui)(hui)(hui)(hui)的業務指導和(he)督促檢查(cha)(cha)(cha)。

第三十五條   事業單位工(gong)會(hui)(hui)經費(fei)審(shen)查(cha)(cha)委(wei)員(yuan)會(hui)(hui)審(shen)查(cha)(cha)審(shen)計(ji)同級工(gong)會(hui)(hui)組(zu)織的(de)經費(fei)收支、資產管(guan)理等全部經濟(ji)活動,定期(qi)向(xiang)會(hui)(hui)員(yuan)大(da)(da)會(hui)(hui)或者會(hui)(hui)員(yuan)代表大(da)(da)會(hui)(hui)報告(gao),并(bing)采取一定方式公開,接受會(hui)(hui)員(yuan)監督。經費(fei)審(shen)查(cha)(cha)委(wei)員(yuan)會(hui)(hui)對審(shen)查(cha)(cha)審(shen)計(ji)工(gong)作中的(de)重大(da)(da)事項,有權向(xiang)同級工(gong)會(hui)(hui)委(wei)員(yuan)會(hui)(hui)和上一級經費(fei)審(shen)查(cha)(cha)委(wei)員(yuan)會(hui)(hui)報告(gao)。工(gong)會(hui)(hui)主席任期(qi)屆(jie)滿或者任期(qi)內離任的(de),應當按照規定對其進(jin)行經濟(ji)責任審(shen)計(ji)。

第(di)八章   女職工工作

第三十(shi)六(liu)條   事業單位工(gong)(gong)(gong)(gong)(gong)(gong)會(hui)(hui)(hui)有女(nv)(nv)會(hui)(hui)(hui)員(yuan)(yuan)十(shi)人以上的建(jian)立工(gong)(gong)(gong)(gong)(gong)(gong)會(hui)(hui)(hui)女(nv)(nv)職工(gong)(gong)(gong)(gong)(gong)(gong)委(wei)(wei)(wei)員(yuan)(yuan)會(hui)(hui)(hui),不(bu)足(zu)十(shi)人的設女(nv)(nv)職工(gong)(gong)(gong)(gong)(gong)(gong)委(wei)(wei)(wei)員(yuan)(yuan)。女(nv)(nv)職工(gong)(gong)(gong)(gong)(gong)(gong)委(wei)(wei)(wei)員(yuan)(yuan)會(hui)(hui)(hui)與(yu)工(gong)(gong)(gong)(gong)(gong)(gong)會(hui)(hui)(hui)委(wei)(wei)(wei)員(yuan)(yuan)會(hui)(hui)(hui)同(tong)時建(jian)立,在同(tong)級工(gong)(gong)(gong)(gong)(gong)(gong)會(hui)(hui)(hui)委(wei)(wei)(wei)員(yuan)(yuan)會(hui)(hui)(hui)領導下開展工(gong)(gong)(gong)(gong)(gong)(gong)作(zuo),接受上級工(gong)(gong)(gong)(gong)(gong)(gong)會(hui)(hui)(hui)女(nv)(nv)職工(gong)(gong)(gong)(gong)(gong)(gong)委(wei)(wei)(wei)員(yuan)(yuan)會(hui)(hui)(hui)指導,任期與(yu)同(tong)級工(gong)(gong)(gong)(gong)(gong)(gong)會(hui)(hui)(hui)委(wei)(wei)(wei)員(yuan)(yuan)會(hui)(hui)(hui)相(xiang)同(tong)。女(nv)(nv)職工(gong)(gong)(gong)(gong)(gong)(gong)委(wei)(wei)(wei)員(yuan)(yuan)會(hui)(hui)(hui)委(wei)(wei)(wei)員(yuan)(yuan)由同(tong)級工(gong)(gong)(gong)(gong)(gong)(gong)會(hui)(hui)(hui)委(wei)(wei)(wei)員(yuan)(yuan)會(hui)(hui)(hui)提名,在充分(fen)協(xie)商(shang)的基礎上組成或者選(xuan)舉(ju)產(chan)生。女(nv)(nv)職工(gong)(gong)(gong)(gong)(gong)(gong)委(wei)(wei)(wei)員(yuan)(yuan)會(hui)(hui)(hui)主(zhu)任由事業單位工(gong)(gong)(gong)(gong)(gong)(gong)會(hui)(hui)(hui)女(nv)(nv)主(zhu)席(xi)或者女(nv)(nv)副(fu)主(zhu)席(xi)擔任,也可以經民主(zhu)協(xie)商(shang),按照同(tong)級工(gong)(gong)(gong)(gong)(gong)(gong)會(hui)(hui)(hui)副(fu)主(zhu)席(xi)相(xiang)應(ying)條件(jian)選(xuan)配(pei)女(nv)(nv)職工(gong)(gong)(gong)(gong)(gong)(gong)委(wei)(wei)(wei)員(yuan)(yuan)會(hui)(hui)(hui)主(zhu)任。

第三十(shi)七條   女(nv)職(zhi)(zhi)工(gong)(gong)(gong)委員會的基本任務是(shi):依法(fa)維護女(nv)職(zhi)(zhi)工(gong)(gong)(gong)的合法(fa)權益(yi)和特殊(shu)利(li)益(yi);組織(zhi)實(shi)施女(nv)職(zhi)(zhi)工(gong)(gong)(gong)提升(sheng)素質建功立業(ye)工(gong)(gong)(gong)程,全面提高女(nv)職(zhi)(zhi)工(gong)(gong)(gong)的思想(xiang)道德、科學文(wen)化(hua)和業(ye)務技(ji)能素質;開展家庭文(wen)明建設工(gong)(gong)(gong)作(zuo)(zuo);關(guan)(guan)注(zhu)女(nv)職(zhi)(zhi)工(gong)(gong)(gong)身心(xin)健康,做(zuo)好關(guan)(guan)愛幫困工(gong)(gong)(gong)作(zuo)(zuo);加強工(gong)(gong)(gong)會女(nv)職(zhi)(zhi)工(gong)(gong)(gong)工(gong)(gong)(gong)作(zuo)(zuo)的理論政策研究;關(guan)(guan)心(xin)女(nv)職(zhi)(zhi)工(gong)(gong)(gong)成長進步,積極發現、培養、推(tui)薦女(nv)性人(ren)才(cai)。

第三(san)十八條(tiao)   女(nv)職工委(wei)(wei)員(yuan)會定期研(yan)究涉及(ji)女(nv)職工的有關問題,向同級(ji)工會委(wei)(wei)員(yuan)會和(he)上級(ji)工會女(nv)職工委(wei)(wei)員(yuan)會報(bao)告工作,重(zhong)要(yao)問題應提(ti)交職工代表(biao)大會審議(yi)。事業單位工會應為女(nv)職工委(wei)(wei)員(yuan)會開展工作與活動提(ti)供必要(yao)的場(chang)地和(he)經費。

第九章   附   則

第(di)三十九條   民辦(ban)非(fei)企業單位 (社會服務(wu)機(ji)構)工會參照本條例執行。

第四(si)十條(tiao)   參照公務員法管理的事(shi)業單(dan)位工(gong)會和承擔行(xing)政職能的事(shi)業單(dan)位工(gong)會,依照 《機關工(gong)會工(gong)作暫行(xing)條(tiao)例》

執行。從事生產經營活(huo)動的(de)事業單位工會,依照 《企業工會工作條例》執行。

第四十一(yi)條   各(ge)省、自治區、直(zhi)轄(xia)市總工會可(ke)依據(ju)本條例,制定具體實施辦法(fa)。

第(di)四十二條   本(ben)條例由中華(hua)全國總(zong)工會負責解釋。

第四十三(san)條(tiao)   本條(tiao)例自公布之日起施行。
